A legal disclaimer

1) Who we are

These Terms govern your access to and use of the websites, forms, content, and services operated by World Scholars Exchange Inc. (“WSE,” “we,” “us,” “our”) (collectively, the “Site”). By using the Site, you agree to these Terms and to our Privacy Policy.

2) Eligibility & program scope

  • The Site is intended for individuals 13 years and older. Program participation by minors requires verifiable parent/guardian consent.

  • Information on the Site is general and informational. Program placement depends on eligibility (e.g., screening, school fit, visa processes, availability) and is not guaranteed.

3) Your account & accuracy of information

If you create an account or submit forms, you agree to: (a) provide accurate, current, and complete information; (b) keep your credentials confidential; and (c) notify us of any unauthorized use. You are responsible for activity under your account.

4) Acceptable use

You agree not to:

  • Break the law, infringe rights, harass or harm others, or submit unlawful, defamatory, or discriminatory content.

  • Interfere with Site security, probe or scan systems, or upload malware.

  • Scrape, bulk-download, or replicate the Site without written permission.

  • Impersonate any person or misrepresent your affiliation with WSE.
    We may suspend or terminate access for violations.

5) Content you submit

“User Content” includes information, photos, videos, testimonials, and messages you submit. You represent you have the right to share it (and, where applicable, parent/guardian permission). You grant WSE a non-exclusive, worldwide, royalty-free license to host, use, reproduce, and display User Content solely to operate and promote our programs, subject to any written media/consent form you sign. We may edit or remove User Content that violates these Terms.

6) Intellectual property

All Site content (text, graphics, logos, photos, video, and software) is owned by WSE or our licensors and is protected by law. You may view the Site for personal, non-commercial use. Any other use (including copying, distribution, or creation of derivative works) requires prior written permission.
Trademarks: “World Scholars Exchange Inc.” and our marks may not be used without permission.

DMCA/Copyright notices

If you believe content infringes your copyright, email world.scholars.exchange@outlook.com with: (1) your contact info; (2) a description/URL of the material; (3) a statement of good-faith belief; (4) a statement under penalty of perjury that your notice is accurate; and (5) your signature.

7) Program safety & screenings

For host families/volunteers, eligibility may require references, interviews, home visits, and background checksconducted by vetted vendors. Screening data is used only for safety/eligibility per our Privacy Policy.

8) Donations & payments

Donations and fees may be processed by third-party providers. WSE does not store full payment card numbers. Unless stated otherwise, donations are non-refundable. Receipts will be issued for tax purposes as permitted by law. We do not provide legal or tax advice—consult your advisor.

9) Third-party links & tools

Our Site may link to third-party websites, widgets, or services (e.g., maps, payment, social media). We are not responsible for their content, availability, or practices. Use of third-party services is at your own risk and may be subject to their terms.

10) Privacy & cookies

Your use of the Site is also governed by our Privacy Policy, which explains what we collect, why we collect it, and your choices. Limited cookies/analytics may be used to improve the Site.

11) Communications & consent

By providing contact information, you consent to receive transactional communications (e.g., confirmations, program updates). You may opt in/out of non-essential emails or SMS at any time using provided methods. Messaging/data rates may apply.

12) Accessibility

WSE aims to meet WCAG 2.2 Level AA where feasible. If you encounter a barrier or need an alternative format, contact us and we will assist. See our Accessibility Statement for details.

13) Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WSE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free.

14) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PROGRAM INFORMATION. Our total liability for any claim shall not exceed the greater of $100 or the amount you paid to WSE for the Service giving rise to the claim.

15) Indemnification

You agree to defend, indemnify, and hold harmless WSE from claims, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your: (a) use of the Site; (b) User Content; or (c) breach of these Terms or applicable law.

16) Governing law & venue

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules. You consent to exclusive jurisdiction and venue in the state or federal courts located in Marion County, Indiana for any dispute not subject to informal resolution.

17) Changes to the Site and Terms

We may modify the Site or these Terms at any time. Updates will be posted with a new Effective date. Your continued use after changes means you accept the updated Terms.

18) Termination

We may suspend or terminate access to the Site (in whole or part) at any time, with or without notice, for any reason, including violations of these Terms. Sections that by nature should survive termination (e.g., IP, disclaimers, limitations, indemnity, governing law) survive.
